Recommendation: do not bid, there is nothing to bid on, watch for the Nevada statewide EHR solicitation

Recommendation: do not bid. This is not a competitive solicitation. It is a sole source waiver that lets Nevada keep paying its incumbent EHR vendor for one more year. The real opportunity is named inside the waiver, and it has not been issued yet.

The listing that reached the queue was wrong in almost every field. The correction matters more than the verdict, so it is set out first.

What this item actually is

"SW-120541" is not a Nevada solicitation number. It is an RFPMart catalogue number. RFPMart republishes public notices behind a $7 paywall and renumbers them. Its summary also carried a boilerplate error, describing the buyer as "looking for expert vendor for state intergovernmental relations and lobbying services", which contradicts its own scope text.

The real record is NevadaEPro bid 40DHHS-S4040, titled "SOLICITATION WAVIER, COMMUNITY HEALTH NURSING". The State's own bulletin describes it plainly:

DPBH - Community Health Nursing seeks a noncompetitive contract with Patagonia Health, Inc for implementation and maintenance of a comprehensive cloud-based patient electronic health record system based on the justification listed in the attached Solicitation Waiver.

The authorisation line is the giveaway:

Agency above authorized to contract absent competitive procurement pursuant to NAC 333.150. Parties may contest authorization within 11 days.

The answer to the check

The check asked for the closing date, the buying agency, and whether the Carequality link is mandatory. All three are answered.

There is no closing date, because there is no competition. The NevadaEPro bid opening date was 15 October 2026 at 5:00pm, which was yesterday. That date governed the window to contest the waiver, not a window to bid. The 21 November 2026 "deadline" on the aggregator is RFPMart's own expiry date for its listing.

The buying agency is the State of Nevada, Department of Human Services, Division of Public and Behavioral Health, Community Health Nursing Program. NevadaEPro records it as department 406 Public and Behavioral Health, location 3224 Community Health Services. The Purchasing Division of the Department of Administration administers the waiver.

The Carequality link is in scope and separately funded. The waiver splits the contract value as "$88,504.92 (Core services - $70,204.92; Health Information Exchange = $18,300)". The scope says Patagonia "will also connect the CHN Program electronic health record (EHR) to the national Carequality health information exchange (HIE)". So the buyer is paying a line item for exactly the capability Carepatron does not have. That is known-gap-no-hl7-fhir, which states we have no HL7 or FHIR interfaces and exchange data through the public API, file import and CSV export.

The lead that is actually here

The waiver justification names a future competitive procurement twice, in the agency's own words. Question 3, on why no market research was done:

State Purchasing is currently leading the effort to establish a statewide Electronic Health Record (EHR) solution. As a result, independent market research was not conducted to avoid duplicating work already underway through this statewide procurement initiative.

Question 5b, on why alternatives were not evaluated:

State Purchasing is in the process of establishing a statewide EHR contract, and Division of Public and Behavioral Health (DPBH) must continue services while the statewide contract is being developed.

So the one year contract is a bridge. Nevada State Purchasing is building a statewide EHR contract now, and DPBH is holding its current system together until that lands.

The incumbent and the numbers

Everything below is from the waiver form, which is a scan. It was read page by page after the host returned no extractable text.

Two things stand out. The prior contract ran five years for $350,342.32, which is about $70,000 a year across the programme. The bridge renews at the same rate. This is a small contract by state standards, and the price point is not out of reach.

Nevada DPBH states on its own programme page that "CHN operates eight community health nursing clinics in rural and frontier Nevada", located in Dayton, Ely, Fernley, Pahrump, Panaca, Tonopah, Winnemucca and Yerington. Eight rural outpatient clinics running immunisation, STI, TB, family planning and well child services on a sliding fee scale is close to the centre of the Carepatron target. The waiver does not state a user count.

Score

  1. The buyer is right and the money is plausible, but there is nothing to respond to and

the stated scope includes a gap we cannot cover.

DimensionWeightScoreWhy
Product fit3520Appointment through billing in a cloud EHR is core. The funded Carequality HIE link is not.
Buyer fit2016Eight rural outpatient public health clinics. The rubric names small public health clinic programmes as sweet spot.
Size fit157Eight clinics would fit well. A statewide consolidation might not, and the scope is unknown.
Winnability152Zero today. The waiver is approved and the incumbent has held the account since 2021.
Feasibility153Nothing exists to respond to. The contest window closed on 15 October.

The honest reading of the winnability line: Patagonia has five years of configured workflows, data models and interfaces inside this programme, and the agency says moving would "introduce patient safety and continuity of care risks". Displacing that at renewal is hard. Winning a place on a new statewide contract before the programme is forced onto it is a different and better proposition.

The risk on the statewide contract

One caution against getting excited. A statewide EHR that merges Nevada's health programmes into a single system may be enterprise consolidation, which the rubric disqualifies outright, and may exceed 500 seats. The CHN programme on its own is a good fit. The statewide contract it is about to be folded into may not be. That question cannot be answered until State Purchasing publishes something, and it is the first thing to read when they do.

Coverage

No requirements were answered, because no response was drafted. Nothing in this note claims a Carepatron capability.

One library reference is used: known-gap-no-hl7-fhir, cited for the Carequality health information exchange line item.

Questions for Glen: none on product. This is a procurement timing question, not a capability question.

Recommended next steps

One action, and it is not urgent.

  1. Carlos: nothing to do this week. The radar now holds this as a watch item with a check date of 14 January 2027. The one thing to look for is a Nevada State Purchasing statewide EHR solicitation on NevadaEPro. If it appears earlier, it will surface through the daily scorer on its own.
